Justiça, que sopesa qualidade e quantidade (cf. Aristóteles), construindo

hierarquias. O estabelecimento do equilíbrio de muitos equilíbrios, por-

tanto, é intrínseco à epistemologia da Justiça em si mesma e por si mes-

ma, diante da profícua potência (cf. Humboldt) de dualidades que provém

da Política. Este ensaio pretende, portanto, discorrer sobre o que se pode

nomear de função (resolutiva), metafunção e epifunção da Justiça, cuja

ocupação é o Bem das sociedades em seus decursos históricos, jurídicos,

diplomáticos, simbólicos, econômicos.

ABSTRACT:

Societies grow around values such as cultural and ethical,

constantly submitted to its components, expressed by discursive practi-

ces. This dialogic characteristic of the society – which comes among di-

fferent and often divergent interests – gives them dynamicity, linked to

the concept of Politics (cf. Plato and Aristotle). From this plurality, conflicts

and disputes, risks and uncertainties (cf. Lafer) are born, which need, by

a natural or moral prism (cf. Hobbes and Grotius), the deep dialectics (cf.

Hegel), functionalist and formalist at the same time, in which scientific

and philosophical methodology emanates a sentence able to contemplate

both the absolute and relative values, according to the need and the stage

of what is being judged. Justice, in this complex framework, is responsible

for establishing the synthesis of concrete facts, from a seat where it can

glimpse the ideal (cf. Kant) immanent to the past, present and future of

the people to whom jussive service is provided. This regulatory role of

frequent tense social parameters implies a possible definitions of Justice,

which weighs quality and quantity (cf. Aristotle), building hierarchies. The

establishment of the balance of many balances, therefore, is intrinsic to

the epistemology of Justice in itself and for itself, before the fruitful power

(cf. Humboldt) of dualities that come from Policy. This paper therefore

aims to discuss what can be named (resolutive) function, metafunction

and epifunction of Justice, whose occupation is the Good for the societies

in their historical, legal, diplomatic, symbolic, economic paths.
