RESUMO
: A apresentação deste trabalho visa a trazer uma reflexão sobre
outros caminhos para a questão do encarceramento por meio da mudança
de paradigma. A experiência da Justiça Restaurativa em diversos países apon-
ta para um novo pensamento sobre a necessidade do aprisionamento, mas
também para uma abordagem mais eficaz do desencarceramento. Objetiva-
-se ainda nestas breves considerações despertar a curiosidade sobre o tema
e instigar o raciocínio para a investigação da inspiração filosófica para a
assunção desse novo caminho pelo operador do Direito.

ABSTRACT:
The presentation of this work aims to bring a reflection
on other ways to the matter of incarceration, through the paradigm shift.
The experience of Restorative Justice in several countries points to a new
thought about the need for imprisonment, but also for a more effective
approach the prison release. One of the aims of these brief considerations
is also to arouse curiosity on the subject and instigate the reasoning for the
investigation of the philosophical inspiration for the assumption of this
new way by the legal practitioner.
