Consequentemente, este artigo conclui que está equivocada a jurisprudência tradicional que sustenta que a via crucis percorrida pelo consumidor, ao enfrentar problemas de con- sumo criados pelos próprios fornecedores, representa “mero abor- recimento”. Abstract: It is well recognized that countless suppliers, quite often, engage in unfair business practices and deliver defective products and services to the consumer market. In addition, many of those suppliers, in the face of consumer complaints, still resist resolving quickly and effectively the consumption problems they have created. Such behavior leads the needy and vulnerable consumer to expend his or her vital time, to postpone or suppress some of his or her existential activities, and to divert his or her competencies from these activities, either to satisfy a certain need, to prevent a loss, or to re- dress a damage. Such a series of acts characterize the “diversion of the consumer’s productive resources”, which is the harm-producing activity that causes injury to the consumer’s vital time and dignified existence, a consumer who necessarily suffers noneconomic damage of an existential nature, which is recoverable in re ipsa . Consequently this article concludes that the traditional case law is mistaken to af- firm that the hardship the consumer undergoes, when facing con- sumption problems, represents “mere annoyance”.
