However, for a long time, the legislation prohibited the pharmaceutical inventions protection through pa- tents, this type of protection having only been possible after Law 9,279 of 1996. In conclusion, it is believed that there should be a ba- lance between the company’s right to recover the invested resource and make a profit by the development of a certain technology and the population’s rights in relation to their health. The advent of the new coronavirus pandemic has led many to address the question of how to mitigate the patent protection of potentially useful phar- maceutical products for the covid-19 treatment. INTRODUÇÃO As invenções são um tipo específico de criação intelectual e são passíveis de serem protegidas por meio de patentes, des- de que sigam alguns pré-requisitos descritos em lei. As inven- ções são o resultado do esforço intelectual do inventor e buscam sempre uma solução técnica para algum problema encontrado na prática (MAGALHÃES; 2011, p. 107). O sistema de patentes é ummeio de conceder um retorno para o investimento intelectual e financeiro do inventor e, também, fazer com que a descrição dessa solução técnica seja tornada pública (CHAVANNE; BURST apud PARANAGUÁ; REIS, 2009, p. 24). A indústria farmacêutica, em 2018, movimentou no mundo 1,2 trilhão de dólares, com uma projeção de que em 2023 movi- mente 1,5 trilhão de dólares (PHARMACEUTICAL COMMER- CE, 2019). Considerando que a indústria farmacêutica é cons- tituída por empresas que trabalham com inovação e que seus novos produtos e processos são muitas vezes protegidos por pa- tentes, podemos perceber a importância do sistema de patentes para essas empresas.
