A interconexão ao sistema notário-registral do título executivo extrajudicial, oriundo dos acordos de mediação, facilita o cum- primento das obrigações, dado os efeitos gerais da publicidade e fé pública, diferente do alcance da coisa julgada, restrita às partes do processo, e sempre pós-conflitual. ABSTRACT: This article aims at demonstrating the effec- tiveness against third parties of mediation agreements between private parties, regardless of judicial approval, invoking juris- prudence of the Superior Court of Justice, which refuses to ratify extrajudicial transactions. In Brazil, it is usual to ratify in court agreements subject to private negotiations, a practice that inte- rested parties seek to extend to the final terms of mediation. The trend towards de-judicialization reinforces the principle of ines- capability of jurisdiction, established in the Constitution (art.5, XXXV), by reserving judges and courts for the judgment of indis- putably contentious cases. The interconnection to the notary-re- gistry system of the extrajudicial enforceable title, arising from mediation agreements, facilitates the fulfillment of obligations, given the general effects of publicity and public faith, different from the scope of res judicata, restricted to the parties to the pro- cess, and always post-conflictual.
