EMERJ, Rio de Janeiro, v. 24, n. 1, p. 144-165, Jan.-Abr. 2022  145 as teorias da justiça na filosofia política contemporânea, funda- mentando em Kant, dentre outros autores, as adversidades en- frentadas pelos refugiados na proteção de suas criações, consi- derando as peculiaridades, singularidades e vulnerabilidades desse grupo, no contexto mundial. Os dados apresentados foram levantados mediante pesquisa bibliográfica, intertextualizando conceitos, obras e temáticas de diversas literaturas, teorias e con- textos históricos, através de uma análise dogmática, em especial na interpretação de normas do Direito Interno e do Direito In- ternacional – tocante à propriedade intelectual –, bem como te- órica/filosófica do tema, o Direito Internacional dos Refugiados – vertente do Direito Internacional dos Direitos Humanos – e o sistema de concessão e proteção a essas pessoas que se encon- tram em situação bastante vulnerável. Nesse contexto, conclui-se que a propriedade intelectual deve considerar sua função social por meio de um paradigma coletivista que contemple os direitos do autor sobre sua obra, em especial no que tange às criações dos refugiados, as quais têm dentre seus objetivos principais o incentivo à inovação e ao desenvolvimento. ABSTRACT: The purpose of this article is to present con- siderations on the protection of the scientific, artistic and litera- ry production of refugees from a kantian perspective, in view of the right to information and the participation of this group in decision-making processes related to the intellectual proper- ty protection regime. To this end, it is part of the debate on the theories of justice in contemporary political philosophy, basing in Kant, among other authors, the adversities faced by refugees in the protection of their creations, considering the peculiari- ties, singularities and vulnerabilities of this group, in the global context.
