EMERJ, Rio de Janeiro, v. 24, n. 1, p. 116-143, Jan.-Abr. 2022 117 ABSTRACT: The article proposes to face the need of re- modeling the Brazilian Federal Constitution of 1988 to include, in the article 103 of its text, the active legitimacy of the Federal General Public Defender to propose actions aimed at abstract control of constitutionality towards the Federal Supreme Court and remove a law or normative act from the legal system. From the demonstration that access to justice is a fundamental right and that the Public Defender’s Office, especially in the last two decades, was reconfigured to detach itself from the idea of an ac- tion linked only to the beneficiary’s economic situation, the text proposes, as a way of deepening the redemocratization process, a healthy expansion of the list of legitimate assets. Throughout the article, the main arguments supporting the conclusion that the Constitutional Amendment Proposals aimed at recognizing the possibility of the Public Defender’s Office acting in the abs- tract control of constitutionality must be approved in the shortest time to correct an imperfection of the current system, still shaped by a logic that no longer holds. INTRODUÇÃO Desde 20 de setembro de 2017, tramita a Proposta de Emen- da à Constituição 31/2017, iniciada no Senado Federal, que tem como escopo incluir o Defensor Público Geral Federal como le- gitimado para a propositura das ações de controle abstrato de constitucionalidade por meio da alteração do artigo 103 da Cons- tituição Federal Brasileira de 1988. Em 25 de abril de 2019, o pro- cedimento encontrou o seu termo na Câmara Alta após a aprova- ção, e, seguindo rito específico, foi encaminhado para a Câmara dos Deputados, onde assumiu o número de Proposta de Emenda à Constituição 61/2019.
