At the present mo- ment, the concept of “crisis jurisprudence” must be updated to the factual reality, involving not only the judgement of the aus- terity measures of the economic crisis, but also of the emergency measures to combat the pandemic, which demand priority even in the discretionary definition of the Supreme Court’s agenda. Within the methodological criteria established in this article, it can be seen that the “crisis jurisprudence” is in the process of for- mation and consolidation in the Supreme Court. The last formal interpreter of the Constitution, therefore, must consider the ex- ceptional/emergency concrete circumstances, the textual limits of the Constitution and the prohibition of social retrocess in this period of economic crisis and calamity of COVID-19. INTRODUÇÃO Segundo Pinheiro (2014, p. 170), “a ‘jurisprudência da cri- se’ traduz um ‘processo negocial’ entre a interpretação normati- va da Constituição e a necessidade de ceder perante as ‘exigên- cias das circunstâncias’”. Nessa ordem transitória e excepcional decorrente da crise financeira de 2007/2008, Portugal firmou um Memorando de Entendimento com a Comissão Europeia, o Ban- co Central Europeu e o Fundo Monetário Internacional ( troika ) para a redução do déficit e o ajuste econômico na política fis- cal portuguesa. O autor aborda que o Tribunal Constitucional de Portugal (TCP) amparou-se no interesse público para decidir pela constitucionalidade de medidas de austeridade que teriam um diferente final em outros tempos, em “manifesta cedência da normatividade à verdade do mundo”.
