The investigation is based on the fol- lowing problem: There is a resistance of acceptance to the Judge of Guarantees, reminiscent of an authoritarian period of validity of the Code of Criminal Procedure, in order to allow the mainte- nance of the inquisitorial system, through which, the broad right of defense remains absolutely impaired in the face of the direc- tion of the collection of evidence in the phase of criminal pros- ecution by the same judge responsible for the trial of the case. It is upheld the absence of any unconstitutionality of Law No. 13,964/19. It is brought with the present text, research led by the German professor Bernd Schünemann, based on the Theory of Cognitive Dissonance, in order to demonstrate the degree of in- volvement of the judge when he is responsible for the collection of evidence, directly affecting his impartiality. INTRODUÇÃO Disciplinam os incisos LIV e LV do art. 5º e o inciso I do art. 129 da Constituição da República, em vigor desde o dia 05 de outubro de 1988, que: “LIV – ninguém será privado da liberdade ou de seus bens sem o devido processo legal” LV - aos litigantes, em processo judicial ou administrativo, e aos acusados em geral são assegurados o contraditório e ampla defesa, com os meios e recursos a ela inerentes. Art. 129 – são funções institucionais do ministério público: I – promover, privativamente, a ação penal pública, na for- ma da lei;” A Carta Magna, definida como Constituição Cidadã, elen- cou, em seus preceitos fundamentais, diversas garantias em fa- vor do cidadão como mecanismo de proteção ao Poder Estatal de controle e restrição das liberdades individuais.
