ABSTRACT : The homestead is an institute that enjoys legal protection by the homeland system and represents an important advance in terms of protection of fundamental rights established by the Constitution of the Republic. The institute enshrines the rule of unseizability, whose study has been raising intense dis- cussions in a doctrine and jurisprudence, especially in the scope of the protection established in Law 8.009/90. Its application re- flects a scenario of gradual protective expansion, which has led to increasingly rich debates about its intended use absolutely, as occurs in cases where the possibility of attach of high value ho- mestead is discussed. Given the legal protection established by the law and the absence of legal provision that excepts the luxury property, comes up a stalemate that requires careful analysis of the grounds and objectives that justify the existence of the insti- tute. In this sense, the present study proposes, in the light of the civil-constitutional methodology, a rescue of the constitutional values ​​that are the direct objectives of the legal protection, ex- tracting findings from the consequences found, especially in the ambit of the luxurious homestead. INTRODUÇÃO O direito a um teto tem simetria direta com o direito de ser e vem despertando olhares atentos de estudiosos, remontando a tempos longínquos a preocupação com sua efetiva proteção. Pontes de Miranda, em suas lições, já afirmava que, fundada historicamente na pessoa, à guisa da liberdade de ir, ficar e vir, a moradia sempre se voltou à salvaguarda da porção espacial necessária ao desenvolvimento adequado dos indivíduos. O ho- mem, à luz de suas fragilidades naturais, é “ente sem defesas de casco, ou de pêlos espessos, ou de epiderme resistente” e, por isso, precisa (mais ainda que quaisquer outros animais) de espa- ço que lhe sirva de proteção (MIRANDA, 1987, p. 183).
