It is approa- ched by an overview of the aspects and peculiarities related to the socio-environmental function within the Brazilian legal sys- tem, especially in the Federal Constitution and in the City Statute Law. In this context, it is strictly necessary to analyze the role of the Master Plan as an instrument of urban policy, as well as the role of the Public Power and society in the face of the need for cooperation to debate, control, demand and fulfill the socio- -environmental function. In the context of this work, it was sou- ght to delimit a set of reflections capable of conducting a critical, reflexive and aerated knowledge about the current situation of the city of São Luís (MA), proposing as a solution the widest po- pular participation in the search for the fulfillment of the socio- -environmental function of property as a means to guarantee the right to property, the right to the environment and, finally, the right to a dignified life.
