Ametodologia de pesquisa utilizada consiste na análise dos dispositivos legais emvigor no Brasil e de textos dou- trinários que abordam o garantismo penal. O objetivo do trabalho é demonstrar a forma como o garantismo penal é indevidamente invocado na prática forense. Os resultados da pesquisa indicamque parte da doutrina tem contribuído para esse desvio de ordem práti- ca. A conclusão é no sentido de que, para embasar as suas teses no garantismo penal, os operadores do Direito devem ter maior com- promisso com as ideias sustentadas por Luigi Ferrajoli. PALAVRAS-CHAVE: Garantismo penal. Integral. Hiper- bólico monocular. ABSTRACT: This work has as its object the penal guarantees theory. The investigation is based on the following problem: how have legal practitioners based their thesis on the penal guarantees theory as devised by Luigi Ferrajoli? In order to analyze this ques- tion, a comparison between the so-called integral penal guarantees theory and the so-called hyperbolic monocular penal guarantees theory is proposed. The justification for this work stems from the fact that the academy cannot be kept apart from what happens in forensic reality. This research may contribute to advancing the un- derstanding of the role of penal guarantees. The research methodo- logy used consists of the analysis of legal provisions in force in Bra- zil and theoretical texts that address penal guarantees. The purpose of this paper is to demonstrate how penal guarantees are improper- ly invoked in forensic practice. The results of this research indicate that part of the doctrine has contributed to this practical deviation. The conclusion is that, in order to base their thesis on the penal gua- rantees theory, legal practitioners must have a greater commitment to the ideas supported by Luigi Ferrajoli.
