EMERJ, Rio de Janeiro, v. 22, n. 1, p. 100 - 147, Janeiro-Março. 2020  101 ABSTRACT: In this study the author analyzes the mechanism of sum- mary judgment of part of a claim with or without a ruling on the merits (i.e. with or without prejudice). This mechanism is ex- pressly provided for in the Civil Procedure Code of 2015. The author examines the following: the circumstances in which a summary judgment can be issued on part of a claim; whether it is possible for the court to make an unliquidated award; the legal classification of a summary judgment that deals with the merits of part of the claim; the relevant avenue of appeal. The author considers the question of when summary judgments become res judicata ( final, binding and no longer subject to appeal) and also considers: the limitation period for the filing of applications to set aside the summary judgment; the issue of non-appealable interlocutory orders issued immediately prior to the summary judgment on part of the claim and whether or not these issues need to be subsequently re-issued. In closing, the author argues that the court, in issuing summary judgment on part of a claim, is entitled to make an order for loss of suit payment of legal fees.
