The Police Inquiry as an instrument of guarantee - A practical analysis based on controlling function of illegal prisons. Substract: This paper discuss the role of the police investigation as an instrument of guarantees against the State, since, originally thought from the inquisitorial point of view, the investigation repre- sents a procedure oriented to the impartial investigation of crimes, ultimately compromised with the penalty application. In this view, it is questioned: Under what circumstances could it be thought as an instrument of guaranteesz? What would be the necessary adaptations to enable and enhance this function? These and other issues will be addressed here, using as methodology the analysis of a very common concrete case in practice that refers to illegal flagrant arrests, without due fulfillment of the necessary requirements. The conclusion is that the police inquiry can and should be thought of as an instrument of guarantees, however, a series of procedural and institutional consi- derations are necessary in order for it to really be seen as intended. Introdução Tornou-se argumento relativamente comum a afirmação de que o inquérito policial, procedimento utilizado pela Polícia Judi- ciária para apuração de delitos, funcionaria em última análise como instrumento para afirmação de garantias do indivíduo. Neste sentido, começou a proliferar passagens doutrinárias e jurisprudenciais 1 afir- mando a posição do Delegado de Polícia como o “primeiro garanti- dor dos direitos fundamentais”. Todavia, é consabido o fato de que o sistema de corte inqui- sitivo, sendo este o adotado pelo ordenamento em relação à in- vestigação criminal em nosso país 2 , entende o processo como uma 1 “O Delegado de Polícia é o primeiro garantidor da legalidade e da justiça”.
