ABSTRACT: The theme of this investigation involves the relationship between the theory of game as an element of culture, by the Dutch historian Johan Huizinga, and the State as a model of organized human society from the Modern Age, in light of the application of the theory of secondary Criminal Law proposed by the Portuguese jurist Jorge de Figueiredo Dias and its impact on the exercise of hierarchical and disciplinary administrative powers, especially regar- ding the latter given the need for prior administrative disciplinary procedure in the application of sanctions for functional failures in the state bureaucracy. The hypothesis to be proved is that the theory of game as an element of culture should be interpreted within the limits of the Democratic State of Law as the ultimate development of the late civilizing process of Western societies, at the end of the 20th century. The applied methodology involves exploratory and qualita- tive research, deductive and based on a bibliographic survey in Law, History and Philosophy. Keywords: Criminal Law, Administrative Law, History, Philosophy, State, Game. 1 PROLEGÔMENOS As civilizações humanas, desde priscas eras, buscam meios para solu- cionar as naturais controvérsias existentes nas relações interpessoais. A Fi- losofia Clássica, na lavra de Aristóteles (384-322 AEC 1 ), já afirmava que o homem é um “animal político”, e, como tal, a sua conformação em torno de sociedades organizadas é inerente à condição que ostenta frente aos demais animais da Terra, ditos irracionais. Todavia, o que separa os homens dos animais? A cultura?
