71 Direito em Movimento, Rio de Janeiro, v. 20 - n. 1, p. 70-93, 1º sem. 2022 ARTIGOS ABSTRACT: This article seeks to analyze the democratic paradigm through the concept of republic. For this purpose, the literature re- view methodology is used. In this threshold, it demonstrates how the distortion of the republican meaning is capable of undermining its legitimacy, as well as adduces, as a consequence, the challenges fa- ced by democracy in the globalized era, including the immeasurable advance of virtual communication, whose effects reflect in the maxi- mization of power and in the transformation of republican freedom into economic freedom. Furthermore, it portrays the current predator of the democratic-republican regime – populism – which dismantles the opposition, undermines independent institutions, silences the press, takes away individual freedoms and popular sovereignty, as well as putting democracy in check. It is concluded that it is necessary to refound the republic on the constitutional basis, through the gua- rantee of fundamental rights and the substantial reach of the norm and, thus, honor democratic government. INTRODUÇÃO Este artigo busca analisar o paradigma democrático sob a ótica da delimitação do conceito de república, na medida em que a criação repu- blicana foi uma conquista fruto de lutas sociais, bem como representou a separação do político com o religioso e o início do processo eleitoral para a figuração de representantes eleitos, em que se pudesse evidenciar a vontade popular. Além disso, possibilitou a autonomia em relação ao antigo regime, bem como reuniu os direitos individuais, gradativamente, nas Cartas Constitucionais. Assim, depois do poder monárquico, que antes era ilimitado, e com o surgimento da república, os governantes passaram a se submeter às leis, e o povo se tornou livre para interferir no cenário político. Dessa feita, a consagração republicana significou um passo para o povo ser titular do poder, já que havia direitos, mas ainda faltava a democracia.
