Violação.  ABSTRACT: In the history of Brazil, we perceive several factors that have caused atrocities to social minorities, above all referring to the interactions between the different peoples that arrived here or between these peoples and the territory where they settled. These atrocities constituted a violation of human rights, based on the language as oppression and a resource available to the State to impose its strength. This work aims at a socio-legal analysis of the imposition of Portuguese in Brazil, considering the phases that characterized the violation of the most important legal asset of human interaction, the language. We adopted the theoretical and methodological assumptions of documen- tary and bibliographic research, using the epistemological bases of Human Rights and Ecolinguistics to study the relationship between lan- guage and the three mental, physical and social environments, where interactions take place. Based on the theoretical dialogue between human and linguistic rights and Ecolinguistics, seeking to recognize linguistic rights as fundamental rights, we analyze two cases that show a violation of linguistic rights in forensic contexts: one at the internatio- nal level; another at the national level.   KEYWORDS: Linguistic rights. Violation.” INTRODUÇÃO A língua portuguesa no Brasil, para ser reconhecida como língua ofi- cial, apresenta pontos controvertidos que necessitam ser vistos numa pers- pectiva crítico-reflexiva, desmitificando a visão de que existe uma demo- cracia linguística. Considerando a história do português no Brasil desde a implantação, emerge a pergunta norteadora deste capítulo: Vivemos uma ditadura ou democracia linguística?
