A violenta e imposta hierarquia dos brancos sobre os negros mostra- se como uma herança do passado escravocrata brasileiro resistente em nossa formação sociojurídica. A metodologia utilizada será de pesquisa documental e bibliográfica e análise comparativa. Os resul- tados apresentam uma importante clivagem, ainda hoje, entre negros e brancos na sociedade brasileira e na norte-americana. ABSTRACT: the present work intends to discuss the ethnic-racial ad- vances and setbacks involving Brazilian and North American socie- ties. For the discussion proposed here, we will use the emblematic case of the New Orleans black girl Ruby Bridges as a paradigm, as she is an icon in the development of civil and social rights, especially educational law for African Americans. In addition, the article totals a fruitful dialogue with structural Brazilian racism, which even after the advent of the Democratic Constitution and public inclusion policies still bitter alarming rates of inequality in the delivery of rights. The he- gemony and the hierarchy among whites over blacks, relive every day the Brazilian slave past and haunts everyone who is unaware of our unequal social formation and a right compromised with privileges. The methodology used will be documentary research and discourse analysis. The results show a strong segregation even today between blacks and whites in Brazilian and North American society. INTRODUÇÃO Diversas formas de discriminação racial desferidas contra a população negra são identificadas em vários locais do globo, mas, especialmente em países com um passado escravocrata, como no caso brasileiro e estaduni- dense, elas se mostram mais violentas e estruturalmente mais resistentes.
