Busca-se analisar as profundas transformações que têm ocorrido na sociedade mundial a partir do surgimento da teoria transconstitucionalista em superação ao constitucionalismo provinciano. Embora fundamental e indispen- sável, o Estado não mais detém o privilégio da análise e resolução de problemas constitucionais. Trata-se apenas de um dentre os di- versos detentores dessa competência na busca do tratamento desses problemas, que estão muito além da jurisdição dos Estados. ABSTRACT: This article reflects on the new legal perspectives in- troduced from the analysis of transconstitutionalism as opposed to provincial constitutionalism - the latter understood as the constitu- tional jurisdiction attached to the National State. The methodologi- cal option involves a descriptive research and systematic review of the literature, carried out through bibliographic and documentary research, with analysis of legal instruments, normative texts, doctrine and jurisprudence. Initially, there will be a socio-legal approach that allows research on the theoretical aspects that involve the theme, through the analysis of the literature already published in the form of books, magazines, articles, separate publications, in short, spe- cialized publications, written press and official data published on the Internet, which directly or indirectly address the topic under analysis in the areas of State Theory, Theory of Law, Constitutional Law, Fun- damental Rights, International Law and Integration Law.
