138 Direito em Movimento, Rio de Janeiro, v. 16 - n. 2, p. 137-148, 2º sem. 2018 ARTIGOS ABSTRACT: With the coming of the Code of Civil Procedure of 2015, its content devices allow measures such as apprehension of habilita- tion, cancellation of credit and blocking of loan as penalties for non- compliance with the execution of court order to satisfy the creditor. The present work aims to bring an analysis of atypical measures or- dered with the purpose of complying with judicial orders. The resear- ch will be constructed mainly by the deductive-bibliographic method, according to which a logical construction is undertaken that allows the analysis of the general for the particular, through bibliographic studies. The contents of civil procedural doctrines will be analyzed and presented due to the depth of the theme. Dialectical study, which generates discussion and argumentation, and the dogmatic-juridical study, which analyzes law, jurisprudence and doctrine, will be under- taken, making analogies and interpretations. In the field of practice and empiricism, through the inductive method, will be sought civil lawsuits that involve the subject, presenting judgments and decisions. Keywords: Atypical measures. INTRODUÇÃO Medidas como restrição ao direito de dirigir, apreensão de passaporte, cancelamento de cartas de crédito, vedação de obtenção de novos emprés- timos, dentre outras restrições observadas a cada caso, são permitidas pela nova sistemática do Código de Processo Civil de 2015, e em regra, não violam direitos fundamentais do devedor. O objetivo da norma é fazer com que o executado, que possui recursos para satisfazer a dívida, pague o débi- to, em razão dessas medidas executivas, trazendo o sucesso e satisfação do crédito. O presente trabalho visa analisar os aspectos legais que embasam a legitimidade da aplicação das medidas executivas atípicas e sua efetividade no ordenamento jurídico.
